Court of Justice judgment in OFCOM v Information Commissioner

The Court of Justice of the European Union has delivered its judgment in Office of Communications v Information Commissioner [2011] EUECJ C-71/10 (28 July 2011), which the Supreme Court referred to the Court for a preliminary ruling on the issue of how the public interest balancing test in the Environmental Information Regulations should be approached when two or more exceptions to disclosure are engaged.  The case concerned a request for the precise locations of mobile phone base stations in the UK.

The judgment follows the Opinion by Advocate General Kokott in March 2011 (see earlier post)
