The Access to Health Records Act 1990

 

Patients' rights of access to health records are now governed by the provisions of the Data Protection Act 1998.

The Access to Health Records Act 1990, which previously provided a right of access to non-computerised health records, has largely been repealed. One part of the 1990 Act is still in force and this gives rights of access to someone who may be entitled to bring a claim for negligence resulting from a person's death to see the relevant parts of that person's health records. This right is available under section 3(1)(f) of the Act.
